Fast UK Hosting Service Policy

This Fast UK Hosting Service Policy (“FSP”) sets forth the basic description of Fast UK Hosting’s Web Hosting Services. This FSP is part of and incorporated into any Fast UK Hosting Website Hosting Agreement (the “Agreement”) between the person or entity identified in the Agreement as the Customer and Fast UK Hosting Limited (“Fast UK Hosting”). Capitalised terms used in this FSP and not defined here shall have the meanings given them in the Agreement.

  1. Conditions of Service

    1. The Customer agrees it will at all times comply with the Agreement and this FSP in its operation of the Website and use of Hosting Services.
    2. Fast UK Hosting reserves the right to refuse or terminate Hosting Services to any Customer if Fast UK Hosting concludes in its sole discretion that the Customer’s actions or Website either pose a risk to Fast UK Hosting's systems or those of its vendors or harm or threaten to harm Fast UK Hosting, its vendors or third parties.
  2. Hosting Service

    Fast UK Hosting will use reasonable commercial efforts to provide Hosting Services to the Customer. Hosting Services shall consist of the provision by Fast UK Hosting to Customer of:
    1. The electronic storage of the Website Code and Website Database. The amount of storage space to be provided to Customer shall be up to, but shall not exceed, 1GB for Website Code and 1GB for Website Database, or the level of such space stated in any Agreement. The Customer understands and agrees that storage location for its Website Code and Website Databse may not be exclusively allocated to the Customer and that such location may be shared among Fast UK Hosting, other customers of Fast UK Hosting and third parties.
    2. Outbound Bandwidth Usage. The included level of outbound bandwidth usage to be provided to Customer shall be up to, but shall not exceed, 10GB/Month or the level of such bandwidth usage stated in any Agreement. If Customer exceeds such level, it shall pay to Fast UK Hosting upon invoice £0.20 for each GB of outbound bandwidth the Customer’s use in any month has exceeded the level included in these terms or any Agreement, whichever is higher.
    3. Support as set forth in the FSP.
    4. Periodic back-up of the Website Code and Website database as set forth in this FSP.
    5. Off-site monitoring to check for the ping response.
  3. Support

    Fast UK Hosting will use reasonable efforts to attempt to correct any failure in Fast UK Hosting’s systems that materially adversely affects the provision of Hosting Services to a Customer (“Fast UK Hosting Support”). The availability of Fast UK Hosting Support is subject to the following terms and conditions:
    1. The Customer must notify Fast UK Hosting of any claimed failure through Fast UK Hosting’s support email address (support@fastukhosting.co.uk). Fast UK Hosting does not, and cannot respond to instant messaging, emails to personal addresses, phone calls or any other communications.
    2. Fast UK Hosting will respond to non-outage support requests within one business day. Fast UK Hosting will respond to outage support requests (Hosting Service is totally unavailable) within 1 hour. Response may be by email or telephone.
    3. THE CUSTOMER ACKNOWLEDGES AND AGREES THAT (i) NOT ALL REQUESTS FOR FAST UK HOSTING SUPPORT CAN BE SUCCESSFULLY RESOLVED AND THAT SOME REQUESTS MAY REQUIRE SIGNIFICANT TIME TO RESOLVE, (ii) THIS FSP IS NOT AN AGREEMENT TO CORRECT DEFECTS OR OTHERWISE TO PROVIDE A POSITIVE OUTCOME IN RESPONSE TO A REQUEST AND (iii) FAST UK HOSTING MAKES NO REPRESENTATION, WARRANTY OR GUARANTY THAT IT WILL BE ABLE TO CORRECT DEFECTS OR OTHERWISE PROVIDE A POSITIVE OUTCOME IN RESPONSE TO A REQUEST.
    4. FAST UK HOSTING WILL UNDER NO CIRCUMSTANCES ALTER, MODIFY, MAINTAIN, FIX, TROUBLESHOOT OR OTHERWISE PERFORM DEVELOPMENT OF ANY KIND ON ANY CUSTOMER APPLICATION OR APPLICATION COMPONENT, INCLUDING BUT NOT LIMITED TO DRUPAL, WORDPRESS, JOOMLA, OR ANOTHER CONTENT MANAGEMENT SYSTEM. CUSTOMERS ARE FULLY AND COMPLETELY RESPONSIBLE FOR THE DEVELOPMENT AND MAINTENANCE OF THEIR APPLICATION AND FAST UK HOSTING WILL NOT SUPPORT OR PROVIDE ADVICE ON APPLICATION CONFIGURATION, DEVELOPMENT OR TROUBLESHOOTING. CUSTOMER UNDERSTANDS THAT MANY APPLICATIONS, APPLICATION COMPONENTS AND APPLICATION CONFIGURATIONS ARE NOT COMPATIBLE WITH THE HOSTING SERVICES PROVIDED BY FAST UK HOSTING, AND THAT FAST UK HOSTING MAKES NO WARRANTY OR GUARANTEE THAT ANY GIVEN APPLICATION WILL WORK OR CAN BE MADE TO WORK WITH THE HOSTING SERVICES PROVIDED BY FAST UK HOSTING. CUSTOMER UNDERSTANDS THAT THEY MAY HAVE TO CONFIGURE, DISABLE OR FUNDAMENTALLY ALTER THEIR APPLICATION IN ORDER TO FULLY UTILISE THE HOSTING SERVICES PROVIDED BY FAST UK HOSTING, AND THAT FAST UK HOSTING DOES NOT PROVIDE THESE SERVICES.
  4. Backups

    Fast UK Hosting will back-up each Customer’s Website Code and Website Database on a daily basis. These back-up services shall consist of:
    1. Fast UK Hosting will maintain and archive all backup copies for a period of 1 week (7 days) after which they will be purged.
    2. Unless the Customer has purchased additional backup storage space, a Customer’s total amount of backups cannot exceed 14GB at any time.
    3. Fast UK Hosting will make reasonable efforts to maintain backups; however, Fast UK Hosting makes no guarantees that backup integrity will be maintained for circumstances outside of Fast UK Hosting's control.
    4. Unless otherwise requested in writing only the following directories and databases will be backed up:
      1. /<your website root>
      2. All MySQL databases
  5. Uptime Assurance Coverage & Limitation; Limitation of Warranty and Liability

    We will use our reasonable endeavours to make our servers available to you as part of the Hosting Service you purchase for ninety-nine point nine nine (99.99) per cent of each calendar month. We do not warrant access to our servers will be uninterrupted or error free but we shall use reasonable endeavours to keep downtime to a minimum. We shall make all commercially reasonable efforts to provide you with advanced notification of all scheduled and emergency outages.

    Service credits are not given for any form of downtime or service unavailability.

    TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FAST UK HOSTING OR ITS SUPPLIERS BE LIABLE FOR ANY SPECIAL, INCIDENTAL, PUNITIVE, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE THE HOSTING SERVICES, EVEN IF FAST UK HOSTING HAS BEEN ADVISED OF, OR SHOULD HAVE KNOWN OF, THE POSSIBILITY OF SUCH DAMAGES. IN ANY CASE AND REGARDLESS OF WHETHER ANY REMEDY HEREIN FAILS OF ITS ESSENTIAL PURPOSE, FAST UK HOSTING’s ENTIRE LIABILITY UNDER ANY PROVISION OF THIS FSP OR THE AGREEMENT SHALL BE LIMITED TO THE REFUND AMOUNT PROVIDED IN SECTION 5. BECAUSE SOME STATES/JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY, THE ABOVE LIMITATION MAY NOT APPLY IF REQUIRED BY LAW.

  6. Modifications to this Fast UK Hosting Service Policy

    Fast UK Hosting, in its sole discretion, may at any time and from time to time to amend in any way this FSP, to change or discontinue any service set forth in the FSP. Fast UK Hosting will post any such amendments to this FSP on its website (www.fastukhosting.co.uk). No such amendment, change or discontinuance shall be effective with respect to a Customer
    1. if Customer is billed and pays fees monthly, until the first day of the second month after the day on which Fast UK Hosting has posted the amendment, change or discontinuance on the Fast UK Hosting’s Website, or
    2. if Customer is billed and pays fees yearly, until the first day of the first billing year after the day on which Fast UK Hosting has posted the amendment, change or discontinuance on the Fast UK Hosting’s Website.
    The effective date of this FSP is 8, April 2014.



Privacy Policy

The Fast UK Hosting Privacy Policy is maintained at http://www.fastukhosting.co.uk/privacy and is hereby incorporated by reference to this Agreement.



Fast UK Hosting Acceptable Use Policy

Introduction

Fast UK Hosting believes that its website Hosting Services Customers should be as free as reasonably possible to take advantage of the Internet’s ability to provide a means for the free and open discussion and dissemination of information. Such freedom cannot be unlimited as there are competing interests, particularly when a Customer’s actions or Website either pose a risk to Fast UK Hosting's systems or those of its vendors or harm or threaten to harm Fast UK Hosting, its vendors or third parties. Fast UK Hosting’s Hosting Services are provided to its Customers under the condition that they will not engage in this type of conduct and this Acceptable Use Policy (“AUP”) sets forth a guide to basic standards for acceptable uses of Fast UK Hosting’s Hosting Services.

  1. General Requirements

    1. This AUP is part of and incorporated into any Fast UK Hosting Website Hosting Agreement (the “Agreement”) between the person or entity identified in the Agreement as the Customer and (“Fast UK Hosting”). Capitalised terms used in this AUP and not defined here shall have the meanings given them in the Agreement.
    2. The Customer agrees it will at all times comply with this AUP in its operation of the Website and use of Hosting Services.
    3. The Customer acknowledges that this AUP is intended only as a general guide to the Customer's obligations when using Hosting Services, sets forth only basic standards for acceptable uses of Fast UK Hosting’s Hosting Services and may not cover all harmful or potential harmful uses. Accordingly, Fast UK Hosting reserves the right to refuse or terminate Hosting Services to any Customer if Fast UK Hosting concludes in its sole discretion that the Customer’s actions or Website either pose a risk to Fast UK Hosting's systems or those of its vendors or harm or threaten to harm Fast UK Hosting, its vendors or third parties.
    4. The Customer understands that Fast UK Hosting cannot monitor, verify, warrant or vouch for the accuracy, legality or quality of the content, information or material which Customer may provide to users of its Website (“Users”) or which Users may provide to Customer through the Website or which Customer or Users may obtain from the Internet through the Website. Fast UK Hosting cannot and does not accept any responsibility or liability, and Customer assumes all responsibility and liability, for any injury to Customer, its Users or others resulting from or arising out of all such content, information and material. The Customer is solely responsible and liable for any content, information or material it or Users furnish to Fast UK Hosting, each other or others in connection with the Website or Hosting Services. Fast UK Hosting does not assume any obligation to monitor such content, information or material or any responsibility or liability for such content, information or material. However, the Customer agrees that Fast UK Hosting may from time to time and at any time access and review the Website or and all such content, information or material whether in response to a third party complaint or for any other reason.
    5. The Customer agrees that is will at all times comply with all applicable local, state, national and international laws, rules and regulations applicable to its Website or the use of the Hosting Services. The Customer represents and warrants that no international, national, state or local authority prohibits or materially limits it from transacting business with Fast UK Hosting or obtaining or using Hosting Services or owning or operating the Website.
    6. The Customer understands and agrees that Fast UK Hosting in no way endorses the Website or any content on the Website, whether originating from the Customer or Users, to be suitable under the terms of this AUP
  2. Prohibited Uses

    1. The Customer agrees that it will not, and will not permit Users to, by use of or access to Hosting Services or the Website:
      1. Conduct any activity or transmit, distribute, upload, post or store any content, information or material in violation of any applicable law, rule or regulation including, without limitation, any content, information or material that
        1. is protected by patent, copyright, trademark, trade secret, software right or other intellectual property right and used without proper authorisation,
        2. is used or disseminated in violation of securities, export control, or governmental secrecy laws,
        3. is obscene, defamatory, libelous, unlawful, harassing, abusive, threatening, harmful, vulgar, constitutes an illegal threat, hate propaganda, fraudulent material or fraudulent activity, invasive of privacy or publicity rights, profane, indecent or otherwise objectionable material of any kind or nature, or
        4. encourages conduct that could constitute a criminal offense, gives rise to civil liability or otherwise violates any applicable local, state, national or international law, rule or regulation;
      2. Transmit, distribute, or store any harmful, malicious, contaminating, destructive or disruptive code or other material including, without limitation, any virus, "Trojan horse," adware or spyware, “time bomb,” “back door” corrupted data, or any software or information to promote or utilise software or any Hosting Services to deliver unsolicited bulk e-mail (“spam”);
      3. Send spam or use any resource on Fast UK Hosting's servers to send spam from another service provider;
      4. Maintain an open SMTP relay;
      5. Run mailing lists unless with the express and verifiable permission of the email address owners on an opt-in basis, which subscription confirmation messages received from each address owner must be kept on file for the duration of the existence of the mailing list;
      6. Use Internet relay chat;
      7. Provide anonymity to activities which are unlawful, fraudulent, violate the intellectual property or other rights of a third party or violate this UAP;
      8. Illegally or without authorisation gain or attempt to gain access to any account or computer, system or network resource whether belonging to Fast UK Hosting or any other party;
      9. Engage in any activities that actually or attempt to harass or cause a denial-of-service to any other party whether on Fast UK Hosting’s network or elsewhere including, without limitation, the initiation of pinging, flooding or mail-bombing;
      10. Interfere with the use or enjoyment of the Fast UK Hosting’s network or other services by other customers or authorised users, including without limitation excessive use of Hosting Services;
      11. Hold Fast UK Hosting (including its affiliates) or their employees or shareholders up to public scorn, ridicule, or defamation;
      12. Forge or misrepresent email message headers, whether in whole or in part, to mask the originator of the email message;
      13. Impersonate any person or entity or misrepresent an affiliation with a person or entity;
      14. Solicit Users from, or collect replies to messages sent from, another Internet service provider where those messages violate this AUP or that of the other provider;
      15. Advertise, transmit or otherwise make available or use any software, product, or service that is designed to violate this AUP; or
      16. Forward Users to any website that, if such website were provided by Fast UK Hosting, would violate the provisions of this AUP.
    2. The Customer also agrees that it is a violation of this AUP for the Website to cause an interruption or degradation of, interference with, or disproportionate burden on Fast UK Hosting's systems, regardless of whether such interruption, degradation, interference or burden is the result of Customer’s actions or those of a third party or parties over which Customer has no control.
  3. Violations

    1. If Fast UK Hosting determines in its sole discretion that any conduct by Customer or its Users violates this AUP, Fast UK Hosting may suspend, restrict, terminate, or take any other appropriate action with regard to Hosting Services supplied to Customer without any obligation to refund fees paid. Fast UK Hosting reserves the right to take such actions without notice to Customer.
    2. Fast UK Hosting reserves the right to conclude that conduct is or may be in violation of this AUP and to arrive at such a conclusion even if it is based upon opinion or mere suspicion or belief, without any duty to prove that such opinion or suspicion is well founded, and even if (i) such opinion or suspicion is proven not to be well founded or (ii) other Fast UK Hosting customers are using Hosting Services in a similar manner to the Customer. The Customer agrees that Fast UK Hosting, in responding to a complaint, reserves the right in its sole discretion to suspend or terminate the Hosting Services without notice and with no obligation to refund fees paid.
    3. In addition to any other rights it may have under this AUP or the Agreement, Fast UK Hosting reserves the right to charge the Customer a service fee of £200 for each use of the Website in violation of sections 2.a of this AUP.
    4. Fast UK Hosting shall under no circumstances be liable for any action it takes, in good faith, to restrict transmission of material that it or any third party considers to be fraudulent, obscene, lewd, lascivious, filthy, excessively violent, harassing, or otherwise objectionable, whether or not such material is constitutionally protected.
  4. Modifications to this Acceptable Use Policy

    Fast UK Hosting, in its sole discretion, may at any time and from time to time modify this AUP. Fast UK Hosting will post any modifications to this AUP on its website (www.fastukhosting.co.uk) at least thirty (30) days before its effective date. Use of the Hosting Services after such effective date will constitute acceptance of the modification.

    The effective date of this AUP is 8 April 2014.
